1) WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide when you register, request information about our products/Services, participate in activities on the Services, complete a purchase, or otherwise contact us.

Personal Information Provided by You (depending on context):

  • Names, email addresses, phone numbers, mailing addresses, usernames
  • Contact preferences; contact or authentication data
  • Billing/shipping addresses and limited payment details (processed by our payment partners)

All personal information you provide must be true, complete, and accurate. Please notify us of any changes.

Information automatically collected

In short: Certain information—such as IP address and device/browser characteristics—is collected automatically when you visit our Services.

We automatically collect device and usage information such as IP address (or proxy), device identifiers, browser type/version, operating system, language preferences, referring/exit URLs, country/approximate location, pages viewed, and timestamps. We use this to maintain security, operate our Services, and for analytics and reporting.

Like many businesses, we collect information via cookies, pixels, and similar technologies (see Section 5).

Device Data may include: IP address, device/app IDs, location (approximate), browser/OS, hardware model, ISP/carrier, and system configuration.

We do not intentionally collect sensitive personal information (e.g., precise geolocation, health data, or biometric identifiers) through our consumer web flows.

2) HOW DO WE PROCESS YOUR INFORMATION?

In short: To provide, improve, and administer the Services; communicate with you; ensure security/fraud prevention; comply with law; and with your consent where required.

If you are in the EU/UK: We process your personal information under the following legal bases, as applicable:

  • Consent (Art. 6(1)(a) GDPR): You may withdraw at any time.
  • Contract (Art. 6(1)(b)): To provide the Services or perform a contract with you.
  • Legitimate Interests (Art. 6(1)(f)): For security, improvement, and certain marketing/analytics where our interests are not overridden by your rights.

If you are in the U.S. or elsewhere: We process your data as permitted by applicable law, including consent, contract, legitimate interests, and legal obligations.

4) WHEN AND WITH WHOM DO WE SHARE YOUR INFORMATION?

In short: We share information with service providers and in specific situations.

Service Providers / Vendors / Contractors / Agents. We share personal information with third parties that perform services for us or on our behalf (e.g., payment processing, fraud prevention, hosting, analytics, email/SMS services, customer support, logistics and shipping, advertising technology). They access information only to perform their duties and must protect it.

Other sharing scenarios:

  • Business Transfers: In connection with (or during negotiations of) a merger, sale of assets, financing, or acquisition.
  • Affiliates: With our parent, subsidiaries, joint ventures, or other companies under common control, bound by this Notice.
  • Business Partners: To offer products, services, or promotions.
  • Public/Community Areas: Information you post in public areas (e.g., reviews, comments) may be visible to others.
  • Legal/Compliance: To comply with law, enforce our terms, or protect rights, property, or safety.

We do not knowingly sell personal information as “sale” may be defined under certain U.S. state laws; where “sharing” for targeted advertising applies, see Sections 5 and 11 for opt-out options.

5) DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In short: Yes. We use cookies, pixels, and similar technologies for core functionality, security, preferences, analytics, and advertising.

We (and certain third parties) use online tracking to:

  • Keep the site secure and functioning (e.g., session management, fraud prevention)
  • Save preferences and improve user experience
  • Measure performance and usage (analytics)
  • Deliver marketing and interest-based advertising (including cart reminders, where applicable)

6) IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

In short: Yes. We may transfer, store, and process information outside your country.

Our servers and some service providers may be located in the U.S. and other countries. If you are in the EEA/UK/Switzerland, these countries may have different data-protection regimes. We take appropriate safeguards (e.g., Standard Contractual Clauses) to protect your data consistent with this Notice and applicable law.

7) HOW LONG DO WE KEEP YOUR INFORMATION?

In short: We keep information as long as necessary for the purposes described, unless longer retention is required/permitted by law.

We retain personal information for the period needed to fulfill the purposes in this Notice (e.g., while you have an account, to provide the Services, to comply with tax/accounting/legal obligations, to resolve disputes, and enforce agreements). When no longer needed, we delete or anonymize it. If immediate deletion is not possible (e.g., backups), we securely store and isolate it until deletion is feasible.

8) HOW DO WE KEEP YOUR INFORMATION SAFE?

In short: We use organizational and technical measures designed to protect your information.

No system is 100% secure. Transmission of personal information is at your own risk. Use the Services only in secure environments and contact us if you suspect unauthorized access or misuse.

We will process requests consistent with applicable laws and may need to verify your identity.

Marketing opt-out: You can unsubscribe from marketing emails at any time via the link in our emails or by contacting support@profanlab.com. We may still send non-marketing communications (e.g., order, account, or legal notices).

Account Information: To review, change, or delete your account information, contact us at support@profanlab.com. We may retain limited information as permitted by law (e.g., to prevent fraud, resolve disputes, or comply with legal obligations).

Cookies: Most browsers accept cookies by default. You can set your browser to remove or reject cookies; some site features may be impacted.

10) CONTROLS FOR DO-NOT-TRACK (DNT) & GLOBAL PRIVACY CONTROL (GPC)

Most browsers and some mobile OS/apps include a DNT setting. There is no uniform standard for recognizing DNT signals, so we do not respond to DNT at this time. Where legally required and technically feasible, we will endeavor to honor GPC signals for opt-out of sale/sharing/targeted advertising. See Section 11 for additional opt-out methods.

11) U.S. STATE PRIVACY DISCLOSURES & RIGHTS

In short: Residents of CA, CO, CT, DE, FL, IN, IA, KY, MD, MN, MT, NE, NH, NJ, OR, RI, TN, TX, UT, VA may have rights to access, correct, delete, obtain copies, and opt out of certain processing (including targeted advertising/“sharing,” and “sale” where applicable). These rights are subject to legal limits.

“Sale” / “Sharing” / Targeted Advertising

We do not sell personal information for money. We may engage in online advertising and analytics that could be considered “sharing” or targeted advertising under certain state laws. You can opt out by:

  • Using available cookie controls and your browser settings, and
  • Contact support@profanlab.com with the subject “State Privacy Opt-Out” (include your full name, email, and relevant identifiers).
    Where offered, use any “Do Not Sell or Share My Personal Information” link on our site.

Your State Rights (subject to verification and legal exceptions)

  • Right to know/access, correct, delete, portability, and non-discrimination
  • Right to opt out of targeted advertising/“sharing,” sale, and certain profiling
  • Where applicable, rights to obtain lists of third-party categories/specific third parties (per CA/DE/MD/MN/OR laws)

How to Exercise: Email support@profanlab.com. You may designate an authorized agent. We will verify your request (we only use submitted data for verification/security).

Appeals: If we decline your request, you may appeal by emailing support@profanlab.com with “Appeal” in the subject. If denied again, you may contact your state Attorney General.

California “Shine the Light” (Civ. Code §1798.83): California residents may request, once per year and free of charge, information about certain disclosures for direct marketing. Submit requests to support@profanlab.com.

12) CHILDREN’S PRIVACY

Our Services are not directed to children under 13 (or under 16 in some jurisdictions). We do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact support@profanlab.com and we will take appropriate steps to delete such information.

13) DO WE MAKE UPDATES TO THIS NOTICE?

In short: Yes. We update this Notice as necessary to stay compliant with relevant laws. The “Last Updated” date reflects the latest revision. If material changes occur, we may notify you by posting a prominent notice or contacting you directly. Please review this Notice periodically.
